The court, citing concerns about the law&#8217;s constitutionality, <a href=\"https:\/\/www.reuters.com\/legal\/us-appeals-court-allows-california-bar-guns-most-public-places-2023-12-30\/\">dissolved a previous order<\/a> that had allowed the ban to take effect on January 1.<\/p>\n<p>The <a href=\"http:\/\/www.inedc.com\/23\/news\/federal-judge-blocks-california-law-restricting-public-carry-of-firearms-cites-second-amendment-violation\/\">initial injunction<\/a>, issued by a judge who deemed the law unconstitutional, faced a temporary suspension from a different 9th Circuit panel last week. However, in a surprising turn of events, a new panel of judges has now lifted the stay, <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/byvrkjknlpe\/01062024california.pdf\">putting the law on hold once more<\/a>.<\/p>\n<p>Gun rights groups, elated by the decision, celebrated the thwarting of what they deemed a &#8220;ploy to get around the Second Amendment.&#8221; C.D. Michel, a lawyer representing these groups, asserted, &#8220;So the politicians&#8217; ploy to get around the Second Amendment has been stopped for now.&#8221;<\/p>\n<p>California&#8217;s battle to defend the ban will continue, with the appeal scheduled to be heard in April. The state&#8217;s attorney general argued in court papers that blocking the law would heighten the risk of gun violence for tens of millions of Californians.<\/p>\n<p>Democratic Governor Gavin Newsom&#8217;s spokesperson, Daniel Villase\u00f1or, expressed concern, stating, &#8220;This dangerous decision puts the lives of Californians on the line.&#8221;<\/p>\n<p>The genesis of the law dates back to a landmark <a href=\"https:\/\/www.reuters.com\/legal\/government\/us-supreme-court-strikes-down-new-york-limits-concealed-handguns-2022-06-23\/\">Supreme Court ruling in June 2022<\/a>. The conservative-majority court, in the case of New York State Rifle &amp; Pistol Association v Bruen, expanded gun rights nationwide. Striking down New York&#8217;s strict gun permit regime, the court declared that the Second Amendment protects the right to carry a handgun in public for self-defense.<\/p>\n<p>California, among the states with laws similar to New York, swiftly moved to overhaul its firearms regulations. The newly contested law, Senate Bill 2, prohibited carrying concealed guns in designated &#8220;sensitive places,&#8221; including hospitals, playgrounds, stadiums, zoos, and places of worship, regardless of concealed carry permits.<\/p>\n<p>U.S. District Judge Cormac Carney, appointed by former President George W. Bush, ruled on December 20 that the law violated the Second Amendment, aligning with permit holders and various advocacy groups.
