El Dorado County, CA (Jan 30, 2025) – District Attorney Vern Pierson has formally requested a legal opinion from California Attorney General Rob Bonta regarding the interplay between state and federal immigration laws. Pierson’s inquiry centers on potential conflicts between California’s Senate Bill 54 (SB 54), known as the California Values Act, and federal immigration enforcement directives.

Enacted in 2018, SB 54 designates California as a sanctuary state, limiting the involvement of state and local agencies in federal immigration enforcement. Specifically, the law prohibits law enforcement from inquiring about an individual’s immigration status, detaining individuals based on immigration holds, or sharing non-public personal information with federal authorities, except under certain circumstances.

In his letter, Pierson expressed concern over the challenges local law enforcement faces due to these restrictions, especially in light of federal mandates from the Trump administration that require cooperation with immigration authorities. He emphasized the dilemma confronting local agencies:

“Without comprehensive guidance from your office, there is significant risk of inconsistent application of the law, which could have far-reaching consequences for our communities and the criminal justice system,” Pierson wrote.

He further highlighted scenarios where individuals involved in serious crimes, such as drug trafficking, might evade federal detection due to state-imposed limitations. Pierson noted that under SB 54, local deputies are restricted from notifying federal officials about the release of certain individuals, even if they pose a threat to public safety.

Attorney General Bonta has previously addressed concerns related to federal immigration policies, stating, “We want to focus on enforcing the criminal laws of the state of California, arresting and prosecuting criminals, not be involved in civil immigration enforcement. I think our roles are clear.”

However, Pierson contends that these roles remain ambiguous and is seeking definitive guidance to ensure that local law enforcement can navigate the complexities of adhering to both state and federal laws without facing legal repercussions.

The outcome of this request could have significant implications for law enforcement agencies across California as they strive to balance state directives with federal requirements.
