{"id":11663,"date":"2026-02-26T19:02:24","date_gmt":"2026-02-27T04:02:24","guid":{"rendered":"http:\/\/inedc.com\/26\/?p=11663"},"modified":"2026-02-26T19:02:24","modified_gmt":"2026-02-27T04:02:24","slug":"el-dorado-county-rejects-brown-act-violation-claim-over-public-comment-procedure","status":"publish","type":"post","link":"http:\/\/inedc.com\/26\/government\/el-dorado-county-rejects-brown-act-violation-claim-over-public-comment-procedure\/","title":{"rendered":"El Dorado County Rejects Brown Act Violation Claim Over Public Comment Procedure"},"content":{"rendered":"<h2 data-start=\"1348\" data-end=\"1431\">El Dorado County Rejects Brown Act Violation Claim Over Public Comment Procedure<\/h2>\n<p data-start=\"1433\" data-end=\"1673\">PLACERVILLE \u2014 A dispute over how the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">El Dorado County Board of Supervisors<\/span><\/span> structures public comment during meetings has escalated, with county officials formally rejecting allegations that the board violated California\u2019s open meetings law.<\/p>\n<p data-start=\"1675\" data-end=\"1963\">In a Feb. 13 letter sent via email, <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">David A. Livingston<\/span><\/span>, county counsel for <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">El Dorado County<\/span><\/span>, responded to a Jan. 16 \u201ccure or correct \/ cease and desist\u201d demand from <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Lee Tannenbaum<\/span><\/span> of the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Taxpayers Association of El Dorado County<\/span><\/span>.<\/p>\n<p data-start=\"1965\" data-end=\"2318\">The association alleges the board violated the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Ralph M. Brown Act<\/span><\/span> when it voted Nov. 18, 2025, to consolidate public comment on most agenda items. According to board minutes cited in the county\u2019s response,<\/p>\n<blockquote>\n<p data-start=\"1965\" data-end=\"2318\">\u201cPublic comment for all Agenda items (excluding Public Hearings) will be taken following consideration of the Consent Calendar.\u201d<\/p>\n<\/blockquote>\n<p data-start=\"2320\" data-end=\"2546\">The Brown Act, codified in Government Code section 54954.3(a)(1), requires that agendas provide an opportunity for the public to address the legislative body \u201cbefore or during the legislative body\u2019s consideration of the item.\u201d<\/p>\n<p data-start=\"2548\" data-end=\"2708\">In his response, Livingston wrote that the law also permits local legislative bodies to adopt \u201creasonable regulations\u201d governing how public comment is received.<\/p>\n<blockquote>\n<p data-start=\"2710\" data-end=\"3012\">\u201cWhile that section requires a legislative body to provide an opportunity for public comment \u2018before or during the legislative body\u2019s consideration of the item,\u2019 it also recognizes that the legislative body can adopt reasonable regulations concerning that opportunity,\u201d<\/p>\n<\/blockquote>\n<p data-start=\"2710\" data-end=\"3012\">Livingston stated in the letter.<\/p>\n<p data-start=\"3014\" data-end=\"3311\">The demand under Government Code section 54960.2 seeks a formal commitment from the board to cease and desist from alleged ongoing violations before litigation may proceed. That section requires such notice prior to filing an action to determine the applicability of the Brown Act to past actions.<\/p>\n<p data-start=\"3313\" data-end=\"3557\">The central issue is whether consolidating comment on non-hearing agenda items \u2014 rather than taking comment immediately before each item \u2014 satisfies the statutory requirement that the public be allowed to speak \u201cbefore or during\u201d consideration.<\/p>\n<p data-start=\"3559\" data-end=\"3864\">The county\u2019s position is that the revised procedure complies with state law because the opportunity to address items remains available prior to final board action. The Taxpayers Association contends the change may limit meaningful participation by disconnecting comment from individual agenda discussions.<\/p>\n<p data-start=\"3866\" data-end=\"4039\">The matter could carry implications for how local governments across California structure meetings amid ongoing debates about transparency, efficiency and public engagement.<\/p>\n<p data-start=\"4041\" data-end=\"4206\">As of this week, no lawsuit had been filed in El Dorado County Superior Court.
