PLACERVILLE, Calif. — El Dorado County’s top law enforcement officials have voiced strong opposition to Assembly Bill 1037 (AB 1037), asserting that the proposed legislation undermines local authority and poses significant public safety risks.​

AB 1037 aims to extend and expand provisions related to the distribution of hypodermic needles and drug paraphernalia, as well as the administration of opioid antagonists. The bill seeks to remove existing sunset clauses, effectively making these provisions permanent, and broadens the scope of individuals authorized to distribute and possess such items. Sheriff Jeff Leikauf expressed deep concerns about the bill’s implications for community safety. He highlighted incidents from the 2024 fire season, noting that several wildland fires in El Dorado County were attributed to unhoused individuals, many of whom struggle with substance abuse.

Leikauf explained. He emphasized that such activities not only increase fire risks but also strain law enforcement resources, potentially delaying responses to other critical incidents.​

District Attorney Vern Pierson echoed these sentiments, criticizing the state’s harm reduction policies. He pointed out that a significant majority of California voters supported Proposition 36 with the intention of moving away from the decriminalization and continued use of hard-core drugs.

“Harm reduction as a policy has failed this state,”

Pierson stated. He advocated for strategies aimed at helping individuals overcome addiction rather than perpetuating substance use.​

The officials contend that AB 1037 represents a broader trend of state overreach, diminishing the ability of local governments to address the unique needs and concerns of their communities. They argue that decisions affecting public health and safety should remain under local jurisdiction to ensure policies are tailored effectively.​
